A federal judge in Oregon has issued a preliminary injunction preventing federal immigration officers from making warrantless arrests without determining if a person is a flight risk. The judge's ruling comes after a daylong hearing in Portland and joins Oregon with Washington, D.C., and Colorado in restricting this practice. The judge cited evidence of a pattern of warrantless arrests without considering flight risk, leading to potential harm for individuals, families, and communities.

The judge emphasized the significant and severe harm caused by the broad-reaching dragnet approach of federal immigration officers, noting the violent and brutal manner of arrests seen in videos. He believes that his injunction will not impede immigration enforcement but rather improve it by requiring officers to document warrantless arrests in narrative form, including the reasons for determining someone as likely to escape.

Attorney Stephen Manning sought the injunction to stop what he called the practice of "arrest first, justify later" by federal immigration officers. He argued that immigrants in Oregon are living under a state of emergency due to warrantless arrests by ICE and U.S. Customs and Border Protection officers. The court was asked to protect vulnerable Oregonians from becoming ICE targets or "collaterals."

Assistant U.S. Attorney Thomas Ratcliffe argued against issuing an injunction, pointing to a recent memo from ICE Director Todd M. Lyons that provides guidance on conducting warrantless immigration arrests. The lead plaintiff, identified as MJMA, and another plaintiff, Victor Manuel Cruz Gomez, shared their experiences of being detained by immigration officers without warrants, highlighting the emotional toll and impact on their lives.

The judge granted class-action status to the lawsuit, allowing the plaintiffs to represent all Oregonians at risk of warrantless arrests by immigration officers. This decision aims to protect individuals' due process rights and ensure that federal immigration officers exercise restraint in their enforcement actions. The ruling seeks to address the concerns raised about the excessive and harmful practices of warrantless arrests in Oregon.
