Instacart Settles with FTC: $60 Million Refunds and Pricing Scrutiny

Instacart has agreed to pay $60 million in customer refunds as part of a settlement with the Federal Trade Commission (FTC) over allegations of deceptive practices. The FTC accused Instacart of misleading customers by falsely advertising free deliveries and not clearly disclosing service fees that can add up to 15% to an order. Additionally, Instacart failed to inform customers that enrolling in a free trial for its Instacart+ program would result in membership fees being charged at the end of the trial period. The company also did not provide adequate refunds or benefits to customers who experienced late deliveries or unprofessional service.
Instacart denied the FTC's allegations but decided to settle in order to focus on its business. The company emphasized its commitment to transparency, affordability, and consumer-friendly service, stating that it complies with the law and exceeds industry norms. Despite the settlement, Instacart's shares fell nearly 2% in after-hours trading.
Separately, Instacart is facing scrutiny over its pricing practices. A recent report by Consumer Reports and advocacy groups found that Instacart charged different prices for the same grocery items, raising concerns about potential use of artificial intelligence tools to increase costs for consumers. While the FTC did not comment on opening a separate investigation into Instacart's pricing policies, it expressed concerns about the allegations.
Instacart clarified that it is not a retailer and does not control base prices on its platform. The company stated that retailers may test prices to gauge consumer sensitivity and that pricing variations observed by Consumer Reports were part of such testing. Instacart emphasized that it does not use shoppers' personal information to set prices and encourages retailers to maintain consistent pricing online and in-store.
The settlement with the FTC underscores the importance of transparency and fair practices in the online delivery industry. Instacart's commitment to addressing the issues raised by the FTC and ensuring clear communication with customers will be crucial in rebuilding trust and maintaining its position in the market.
