Rep. Brandon Gill Introduces Impeachment Articles Against U.S. District Judge James Boasberg for Involvement in 'Arctic Frost' Probe

Rep. Brandon Gill, R-Texas, is introducing impeachment articles against U.S. District Judge James Boasberg for his involvement in the "Arctic Frost" probe. Boasberg has faced criticism from Republican allies of President Donald Trump for approving subpoenas in former special counsel Jack Smith's investigation. Gill accuses Boasberg of compromising judicial impartiality and abusing his power against political opponents, including Republican members of Congress.
The resolution against Boasberg alleges abuse of power, stating that he granted authorization for frivolous nondisclosure orders in the Arctic Frost investigation. These orders covered Members of Congress acting within their legislative duties and privileges guaranteed by the U.S. Constitution. The redacted Arctic Frost documents, made public by Sen. Chuck Grassley, revealed subpoenas of phone records for senators and a House lawmaker, along with gag orders to phone carriers.
Boasberg's signing of the subpoenas and gag orders prompted criticism from Republicans, including Sen. Ted Cruz, who likened the investigation to "worse than Watergate." Federal judges have discretion in approving such orders under the Stored Communications Act. The subpoenas raised concerns about potential violations of the speech or debate clause of the U.S. Constitution, which protects lawmakers from law enforcement actions related to their legislative roles.
Boasberg has faced previous negative attention from Trump and his allies, including impeachment threats earlier this year over a ruling on migrant deportation flights. Despite initial impeachment threats, GOP lawmakers backed off after House Republican leaders suggested alternative routes to address concerns about judicial decisions. The ongoing debate over the separation of powers and congressional protections remains a contentious issue in the political landscape.
