Federal Judge Grants Temporary Restraining Order in Kilmar Abrego Garcia Deportation Case

A federal judge has granted a temporary restraining order to prevent the deportation of Kilmar Abrego Garcia until his court challenge is resolved. The judge extended the restraining order until at least early October, scheduling an evidentiary hearing for October 6 to address the deportation challenge. Abrego Garcia, a Salvadoran native, is currently held in a detention center in Virginia and must remain within a 200-mile radius of the court in Maryland.

The judge emphasized that the decision to release Abrego Garcia from immigration custody should be made by an immigration judge. Abrego Garcia's attorneys have moved to reopen his immigration case and apply for asylum, citing his deportation to El Salvador in March despite a previous court order barring his removal to that country. He faces charges in Tennessee for allegedly transporting undocumented migrants within the U.S. while living in Maryland, to which he has pleaded not guilty.

After being released while awaiting trial, Abrego Garcia was taken into immigration custody upon checking in with the ICE office in Baltimore. His attorneys filed an emergency motion to reopen his immigration case to seek asylum, arguing that his recent deportation and return to the U.S. make him eligible to apply for asylum within one year of his last entry into the country. They also requested that Costa Rica be designated as the country of removal if he is deported.

In light of these developments, the judge has extended the restraining order to ensure that Abrego Garcia's legal rights are protected until the court challenge is resolved. The upcoming hearing on October 6 will play a crucial role in determining the outcome of his deportation case and asylum application. It remains to be seen how these legal proceedings will unfold and what impact they will have on Abrego Garcia's future.
